I was given a court date for impaired driving in Ontario, Canada. What should I do now?
You should hire a lawyer who focuses on DUI cases at the courthouse where your case is at. If you have been given a court date you know that you are being criminally charged. You will also have already been fingerprinted by now or will have an upcoming fingerprinting date. Your case will be dealt with in court and there is no way to go back and talk yourself out of it.The good news is that as of 2021 there are often many ways to fight and win these cases in court. This can include Charter arguments, challenging how you were treated by the police, and myriad other examples. Even if you did drink and drive and got caught by the police this does not mean that you will be found guilty in court. If the police made mistakes in how they treated you or tested or determined your sobriety level you may be able to get the charges dropped, reduced to something non-criminal (HTA offence), or be found not guilty at trial.
One of the big mistakes people make after a foggy recollection the next day is to assume that just because they are factually guilty that they are legally guilty. Some of these people blacked out and have no recollection as to what happened at all. All they know is that they are now facing criminal impaired driving charges upon sobering up.
